The Burns were wearing their seatbelts, but the vehicle’s airbags did not deploy when they were hit in a head-on collision. It is a crime in Texas for a dealer or a repair shop to disable an airbag system and it is a violation of federal law.

Moritz Kia had serviced the vehicle for airbag issues over the years in response to complaints by a prior owner who later traded it into Moritz Kia. Mortiz Kia then sold the troubled internally to its preowned dealer, Discount Motors.

The dealership settled the wrongful death lawsuit out-of-court after The Tracy Law Firm’s Crash Lab discovered that the airbags had not been properly connected.

A Dallas County jury awarded nearly $42-million in damages to a Dallas couple who were crushed and burned in a car accident because John Eagle Collision Center cut insurance costs by using glue instead of welding a car’s metal structure together.

Vehicle safety lawyer Todd Tracy represented 33-year old Matthew Seebachan and his 29-year old wife Marcia. The couple was trapped inside their used 2010 Honda Fit when the glued roof caused the car’s structure to catastrophically collapse and burn.

In December 2013, the Seebachans were on their way to spend Christmas with her grandmother in the Texas Hill Country.  The driver of a Toyota Tundra pickup truck hydroplaned into the path of their car.

The jury held John Eagle Collision Center negligent for using glue to secretly replace the car’s hail damaged metal roof, instead of using 108 structural welds specified by Honda.

Matthew and Marcia Seebachan suffered catastrophic injuries when their Honda was hit by another vehicle in what automotive engineering and biomechanical experts told the jury was an accident that they should have walked away from.

By the time of the trial in October 2017, the Seebachan’s had incurred more than one million dollars in medical bills during the four years since the accident.

Matthew Seebachan is not likely to ever live a normal life due to intense nerve pain caused by 4th-degree burns to his feet. His burn rehabilitation physician from UTSouthwestern Medical Center diagnosed the scale of the pain he has suffered to date and will suffer for the next 17-years as worse than childbirth.

The jury awarded him alone more than $24-million for: physical pain and mental anguish, disfigurement, physical impairment, medical care, lost wages and lost earning capacity in the future.

Since I’ve spent the last thirty-years suing the automakers for safety defects, it’s not often that I agree with them. But Ford Motor Co. confirms for its Ford F-150 pickup what my crash test found for the Honda Fit. 

So-called aftermarket crash parts which are cheap imitations of Original Equipment Manufacturer (OEM) parts are unsafe if not deadly in a wreck.

Ford crash tested an aftermarket hood and aftermarket front bumper brackets for the 2012 F-150. It concluded from the independent tests, “that even slight changes in materials or deviation from proper procedures can have severe consequences.”

Ford conducted its test in the wake of a $42 Million verdict by a Dallas County Jury in my lawsuit against a collision center for using a Non-OEM repair procedure. The collision center’s manager testified that they did not follow OEM standards that called for the use of 108 welds to replace a hail damaged roof on a 2010 Honda Fit.  Instead, he testified that they used glue if they wanted to get paid by State Farm Insurance.
